Although the department can confirm divorces, copies of the records are held by the Clerk of the Superior Court in the county where the divorce was granted.

These records are available by walk-in request at the state office in Atlanta or via mail-in request. Some Georgia counties kept early marriage bonds before 1805; however, Georgia law did not require marriage licenses to be recorded until 1805. Officials were careless in adhering to the law and some marriages were consequently not recorded.
